In 2021 the Supreme Court of Mexico ruled that the limitation of surrogacy access to specific family structures was unconstitutional. Yes. A child born in Mexico automatically acquires Mexican citizenship. You then process your home-country passport at the appropriate embassy in Mexico City. Dual citizenship is possible in most cases.

Yes. Donor eggs and donor sperm are widely used. Gay male couples typically combine their own sperm with donor eggs; same-sex female couples may use partner eggs carried by a surrogate.

Mexico offers comparable legal inclusivity at roughly half the cost of the USA, with shorter travel for American clients. The US offers longer case-law precedent and automatic US citizenship for the baby, which Mexico does not. For many US-based couples, Mexico is the optimal middle ground.
